Registration peculiarities of individuals in the State Register on the basis of documents in electronic form

Registration peculiarities of individuals in the State Register on the basis of electronic documents are determined by Section XIV of Regulation on registration of individuals in the State Register of Individuals – Taxpayers, approved by Order of the Ministry of Finance of Ukraine as of 29.09.2017 № 822, registered in the Ministry of Justice of Ukraine on 25.10.2017 under № 1306/31174 (as amended).

At the request of child’s parents or one of them registration in the State Register is carried out during the state registration of his / her birth. Such registration is carried out within the framework of a comprehensive service “e-Malyatko” according to Procedure for provision of the comprehensive service “e-Malyatko”, approved by Resolution of the Cabinet of Ministers of Ukraine as of 10.07.2019 № 691.

In this case, the Account Card № 1DR is not filled in, registration is carried out on the basis of information contained in application for state registration of a birth, in the amount necessary for registration, obtained through information interaction from the State Register of Civil Status Acts. Information on the assignment of registration number of the taxpayer’s account card from the State Register must be transferred to the State Register of Civil Status Acts and reflected in relevant act record and birth certificate.

Individual aged 14 to 18 who has registered place of residence and who is not registered in the State Register may, at the time of registration of passport of a citizen of Ukraine for the first time, at personal request be simultaneously registered in the State Register under registration number of the taxpayer’s account card with reflection in passport of a citizen of Ukraine.

Such registration is conducted according to Resolution of the Cabinet of Ministers of Ukraine as of 10.07.2019 № 691 “On implementation of draft project to create favorable conditions for realization of children’s rights”.

In this case, the Account Card № 1DR is not filled in, registration is carried out on the basis of information contained in the application form submitted during registration of passport of a citizen of Ukraine. Data required for registration are sent to the State Register in order of information interaction.

Information interaction of the State Register of Civil Status Acts, the Unified State Demographic Register and the State Register in cases specified in Paragraphs 1 and 2 of this Section, type and structure of electronic data transmitted and received, information systems interaction procedures are determined according to Ukrainian legislation.

Registration in the State Register may also be conducted the basis of Account Card № 1DR submitted in electronic form (with provision of relevant electronic copies of documents according to the list specified in this Regulation) by telecommunications, including Electronic Cabinet in compliance with the Laws of Ukraine “On electronic documents and electronic document management” and “On electronic trust services”.

Registration of foreigners or stateless individuals in the State Register for acquiring status of electronic residency of Ukraine and access to electronic services provided in Ukraine is carried out according to Procedure for implementing experimental project on introduction and implementation of electronic residency in Ukraine as of 25.06.2020 № 648.

All data obtained in electronic form for registration in the State Register are processed and used taking into account requirements of the Tax Code of Ukraine, Laws of Ukraine “On information”, “On telecommunications”, “On protection of information in information and telecommunication systems”, “On personal data protection”, as well as other regulations on information protection.
